Lawsuits On For Tropicana Brand Name

The Tropicana Las Vegas is in to a claim requiring branding the name “Tropicana” after they have emerged from Chapter 11 filing. Branding Tropicana means that none of the other casinos can use the name for their business.

Onex Corporation based in Toronto and Alex Yemenidjian, the former MGM Mirage president are the new owners of the property.  They reportedly rejected the proposed 10 million USD for using the name Tropicana for their brand.  The $10 million proposal was forwarded by the former owners of the Tropicana Entertainment LLC.

Following the rejection of the request for the branding a lawsuit has been filed in Delaware. In their suit they claimed that it was “outrageous” for them to pay for their own name.

Renovation of the casino floor, night club and spa facilities are being planned by the new owners of the business.

Adding to the pressure is the claim over the intellectual rights of the Tropicana name by the OpCo Company. It should be noted that the OpCo Company has been controlling the casinos of Tropicana which was located outside the Las Vegas.

The Tropicana Las Vegas stated that “The OpCo debtors are preparing an all out effort to strip Tropicana Las Vegas of the right to use the name Tropicana”

In a response to the fuming complaints of the Las Vegas Tropicana, the OpCo Stated that they have trademarked the name Tropicana years before the bankruptcy and other related issues. They also stated that the trademarked name was actually used in getting secure loans for the casinos.  The Onex Corporation has been requesting a royalty-free license to use the name and the OpCo have filed against their right to be doing so.
